On March 27, 2022, Athena Welfare Society called a General Body Meeting where the main issue discussed was regarding illegal demand of Pratikar Charges and Labour cess by the
builder. The General Secretary explained to the members that they have documented evidence that the builder cannot charge Pratikar Charges and for this, the AWS has to file a case with the High court and assured the residents of a good chance of winning and that the litigation process would cost around two lac rupees. The General Secretary also explained that those owners who have already paid the charges to the builder would get their money back upon a favorable decision. It was unanimously decided that each member will deposit Rs.2500/- with the society to file the case.
But the residents had to face disappointment as the High Court dismissed their petition. An excerpt of the High Court order is as follows.
Court No. – 45, Case: – WRIT – C No. – 16703 of 2019 (Order on Civil Misc. (Modification) Application No.3 of 2022: This application seeks modification of the order dated
16.5.2019 passed by this Court.” Learned counsel for the applicant/intervenor submits that during pendency of this application, there is some further development in the matter and, therefore, the applicant be permitted to withdraw this application, with liberty to file a fresh application/petition, praying for interim relief. Learned counsel appearing for the respondents has no objection to this proposition. Modification application is, accordingly, dismissed with liberty as prayed for. Order on Civil Misc. (Intervener) Application No.2 of 2022: In view of the order passed today on the modification application, this application is dismissed. “
The residents of Apex Athena are now in a state of confusion. However more than 250 residents including a few Executive members of AWS have paid the Partikar charges and Labour Cess to the builder and have got their registry done.
