Supertech Emerald Court, as dream project of the builder, was promoted as a Jewel of Perfection. However, the builder could not commit to his dream and during con-struction the focus was diverted to cut cost, ignored compliance requirements and made fast money resulting in an ‘imperfect jewel’ in the process.
28 August was the second anniversary of India’s first and largest demolition of the unauthorized twin towers.
Delhi High Court case — Dr. B.L. Wadhera vs Govt. of NCT of Delhi 29 May 2003 — providing ref to the case of Delhi Development Authority V. Skipper Construction Co (P) Ltd and Anr. the Apex Court has observed in para 37 as under:
“Before parting with this case, we feel impelled to make a few observations. What happened in this case is illustrative of what is happening in our country on a fairly wide scale in diverse forms. Some persons in the upper strata [which means the rich and the influential class of the society] have made the ‘property career’ the sole aim of their life. A sense of bravado prevails; everything can be managed; every authority and every institution can be managed. Where has the respect and regard for law gone? And who is responsible for it?”
Possession of a highly defective jewel was forced upon residents by the builder to make living difficult for residents. The process of transfer of maintenance of the complex to the residents from 01.01.2018 was without giving of IFMS and fullfilment of mandatory compliance requirements. Dedicated residents took the challenge of representation to all concerned authorities and courts at both individual and collective levels through AAO. Ultimately, the High Court and the Supreme Court pronounced judgements in favour of the residents.
The same reinforced fighting spirit of committed residents to process imperfect jewel to perfection and their efforts are yielding results visible in horticulture, and the ambience within and outside the complex.
