Somebody Parked the Car Blocking Samar’s Driveway, Then Questioned His Right on the Property!

Our resident Samar Singh reported that somebody parked his car across his driveway, blocking his entrance, and then claimed that since his property ended at his gate they had every right to use that space for parking.

This is not an infrequent problem. Normally one accommodates visitors when there is a driver to move that car, but this time there was no one to approach and Samar could not enter his own home! When the owners were finally contacted, they came out quite leisurely without any concern for the inconvenience they had caused to Samar. Most people, in normal circumstances, would have hurried to correct their mistake, but not these people! To make matters worse, they kept grumbling and mumbling continuously, without a trace of regret for their action, ultimately leading to heated arguments. They were ill-mannered enough to ask him for his property papers to prove that it was actually his property! Imagine the crass mentality!

When this incident was posted on the Whatsapp group, many residents reacted sharply and asked what could be done to improve the civic sense of our society.  

Mandeep Vinaik replied: Whoever did this is wrong legally. There is a branch of the law known as the law of Easements and confers rights on the owner of property beyond the strict boundaries of the property itself. This party needs some legal education and lessons in civic sense.

Prashant Sehgal added: There was a major incident in the Sector related to parking a couple of years back, after which we had consulted Noida Authority and the RWA, and had released a set of parking guidelines for the residents. If your offenders were Sector residents, then it is indeed very inconsiderate of them to do so to a fellow resident, and you can try to get the RWA involved if they were repeat offenders. If they were non-residents, you can call the RWA Security to handle the issue on your behalf rather than engaging with such people yourself.

After this incident, the RWA posted the following: Parking of Cars: Many residents complain that the guests coming to nearby houses park their cars in front of adjacent houses, obstructing movement of their cars in and out of their premises, and in some cases, they even behave in a rude and arrogant manner when asked to park their cars away from the place. When guests exhibit such behaviour, this will lead to avoidable tension.

We request  the residents to kindly ensure that the guests do not park their cars in such a way that causes inconvenience to other residents.
