RWCS Complains to NOIDA Authority Against the Club for Violating its Licence Agreement

Authority’s Auditing Team Will Be in the Club Very Soon

After being run down very badly by the club CMC, RWCS president Govind Sharma decided to expose the wrong doings going on in the club.

Let’s understand the relationship between these two important institutions of the sector:

Noida Authority had given RWCS the land on which the club and community center are situated for making a club and a community center.

The agreement made the club an independent entity but had the clause that it is bound to follow its constitution and any amendment to the constitution could be made only after informing the RWCS and Noida authority. The primary reason for this clause was to ensure that the club doesn’t embark on any activity which is not in the interest of the residents as a whole.

We believe that in the last few years the club committee made many constitutional changes without keeping the RWCS and the authority in the loop. The main clause flouted by them was about making new resident members (in the tenant category) and non-resident members.

Govind Sharma time and again warned the club executive committee not to flout the norms of the constitution. No heed was paid to his requests. A month or two back during the club committee meeting Govind Sharma raised this issue again, he was rebuffed and asked to manage his own business of cleaning the sector drains.

This agitated Govind Sharma who felt abused in front of other sector and outside members. Sharma decided to teach the committee members a lesson. He reached for the final sword which was to revoke the licence agreement (which is to be renewed in the next 3-4 years).

He wrote to NOIDA authority the following complaint on 8 June ’23 (Some excerpts):

NOIDA agreed to grant a plot of 9009.31 Sq., meter to RW&CS Sector-26 with an objective to establish a sport and Cultural Club as well as a community center facility for the welfare of Residents of the sector-26.

To implement the above decision, Noida Authority handed over the plot no, E-1 measuring 9009.31 sq. meter to RW&CS vide license agreement dated 13.08.1997 with a token annual lease rent of Rs1/- only to achieve the aforesaid objective. The Rules and regulations of the Club were also made an integral part of the License Agreement.

As per the License agreement, if the grantor (Noida Authority) has reason to believe that the licensee has committed breach of any condition of License, including the violation of the Club Rules and regulations, the grantor can revoke the License or to make any other direction as it may deem fit.

Now, we wish to bring to your kind notice few instances of the gross irregularities, manipulations, misuse of the Assets/ power against the interest of the Residents of the sector-26 (the targeted beneficiaries) and also the high handedness of the present management, which is in power for the past 18 years.

a)In order to remain in power, the present management has been manipulating the electoral roll by removing the names of the members at their whims. Some persons who are neither owners of the houses or even tenants in the sector have been given memberships in the residents category to manipulate the elections of the club.

The present management in last 18 years have carried out many amendments in the Rules and Resolutions of the club without following the due process in the license agreement and the by-laws of the club. Most of the amendments were carried without any reference to the Licensee and Grantor which is mandatory as per License Agreement.

The Present Management of the Club under the President ship of Mr R.K Khosla is using the land as if it is the private property owned by the President of the Club. Mr. R.K Khosla’s Company is giving CSR Funds to one NGO (NAVARATAN FOUNDATION) and promote himself and his family through that fund using the land of the Club. In last two years two activities, one physiotherapy center and one Computer center have been started handing over the land to the NGO for running the above activities. These two activities are not confined only for Club members or Residents of the Sector rather these are open not only for NOIDA but for total NCR. This has further added to the problem for Traffic movement and the parking in the Sector.

In the light of the above we request you as under:

1) To get the detailed investigation / audit of the list of members and all other irregularities.

2)To make Club 26 Accountable / Answerable to the RWCS (Licensee)

3)Two nominees from the Grantor (NOIDA AUTHORITY) should immediately be nominated in the management committee of the club as per License Agreement. We feel that the Senior Manager of work circle II and another Senior Officers with the Rank of DGM (Nominee of the ACEO) may be nominated.

4)The Club should be directed to stop inducting the outside members in the Club with immediate effect to control the Traffic & Parking problem in the Sector. Any further addition in the membership of club should not be allowed without prior approval of R.W & C.S.(Please read President RK Khosla’s reply to this diktat on page 6)
