Illegal Construction in Public Area Impacting Society

Rampant encroachment of public land and area by builders is a common sight in Delhi. MCD and other concerned authorities prefer to turn blind eye to such actions of builders. Most likely many such buildings do not even have completion / occupancy certificate from MCD. In some cases, such encroachments are done after getting completion/ occupancy certificate to avoid action.

The problem would have remained between builders and civic authorities, if it was simply a matter of encroachment of public land/ areas where public at large is not directly affected. The problem now created by builders by encroachment of public land/ areas is affecting the residents and causing Health Hazard for Residents (neighbors of such buildings) and Environment (Trees and Plants). The trees and their leaves in front of these houses are burning because of hot air and dying.

Builders have begun to use public area for hanging / fixing utilities like Air Conditioner out door units, water tanks, Water booster pumps etc. On an average in any such building there are as many as 10 to 12 equipment hanging outside building in public land/area. Greater Kailash-1 is among many few colonies in Delhi which has the privilege of back lane that gives fresh air, cross ventilation and sun to residents. These encroachments force residents to avoid going to portion of the building opening in back lane and keep the doors closed.

Recently a resident complained to President, RWA that air conditioning units hanging outside opposite building were causing lot of health challenges, noise / air pollution and inconvenience to them as hot air from multiple units was directly coming on them and asked RWA to contact MCD for necessary action.

Should RWA’s be responsible for encroachment of back lanes and public spaces?
