General Body Meeting (GBM) At Indosam 75 To Progress AOA Registration

On 29 September 2022, Indosam apartment owners in support with management of Indosam Infra Pvt Ltd had applied for the registration of AOA along with supporting necessary documents including the documents of GBM proceedings. During the process on 24 November, Deputy Registrar had raised an objection on the notice of GBM and the time period provided for holding earlier GBM.

Based on the consultant (lawyer), the way forward advised and agreed by the apartment owners to redo GBM as per the bye-laws guideline and support the earlier Board of Members (7 Apartment Elected Members + 1 Builder Nominated). As per byelaw 15 of the Model Byelaws as prescribed under the Uttar Pradesh Act, 2010, the notice of GBM was shared to all the apartment owners by the election committee (Ad-hoc committee) on 19 December 2022 through email, apartment notice boards, lift lobby notice boards and whatsapp groups for conducting the GBM on 24 December 2022. Copy of same has been sent through registered post to CEO – Noida Authority, Deputy Registrar – Meerut and Indosam Infra Pvt Ltd.

To proceed with the agenda of first GBM, quorum of 30% owners was required to proceed with the GBM agenda. Indosam has 430+ flats which means a quorum of 125+ apartment owners was required to be present – against this only 51 owners attended the meeting. In absence of the complete quorum election committee has adjourned the GBM on 24 December. The minutes of the GMB was shared with all the owners through email and whatsapp group.

As per model byelaws, the notice for adjourned GBM was shared with all the owners by the election committee (Ad-hoc committee) on 26 December 2022 through email, apartment notice boards, lift lobby notice boards and whatsapp groups for conducting the GBM on 1 January 2023. Again, copy of same has been sent through registered post to CEO – Noida Authority, Deputy Registrar – Meerut and Indosam Infra Pvt Ltd.

To proceed with the agenda of adjourned GBM, quorum of NLT one owners was required to proceed with the GBM agenda. As per attendance record 59 apartment owners has attended the GBM on 1 January and unanimously approved all the objections raised by Deputy Registrar, Meerut. The minutes of the GMB was shared with all the owners through email and whatsapp group.

Resolution passed in the GBM, that since the election of the Board of Management (BOM) members of the AOA has already been done, this GBM has approved the election of the BOM to proceed with the process of registration of the AOA. That the elected BOM members and office bearers shall be as follows:Saurabh Saxena – President,i Surjeet Singh – Secretary, Sundeep Kishore Tyagi – Vice President, Rana Gupata – Treasurer, Ashutosh Tripathi – Executive Member, Kamlaker Misra – Executive Member, Saurabh Dixit – Executive Member.

Consultant has been provided with all the necessary documents, records, photos, videos to pursue with the registration of AOA for Apartment owners of Indosam 75.
