Need your help is Saving Dhanauri Wetlands for which I have fought on all levels for 10 years now, with the latest action being an Application in the Principal Bench of NGT.
We need the help of a Senior to emphatically put forth the Concluding and Rebuttal Arguments since we have run into a Wall that just should not be there.
We have prayed and argued for:
a) That directions be issued for the implementation of Specific Condition imposed in Environmental Clearance – under the EIA provisions of Environment Act for the Jewar Airport – granted to Directorate of Civil Aviation, U.P and being implemented by various bodies like YEIDA and others (all Government Agencies)
b) That this Specific condition requires the Project Proponent Conservation Plan to be prepared and implemented in letter and in spirit.
c) Conservation Plan recommends that Dhanauri Wetlands be declared a Wildlife Sanctuary/Conservation Reserve and a Ramsar Wetland of International Importance.
The Wall is in terms of a Justice insisting:
• that the Specific Conditions can only be under the Wildlife Protection Act and under the Ramsar Convention. • NGT has no mandamus under WPA or Ramsar Convention
• that the project proponent – Directorate of Civil Aviation, U.P does not have powers under the WPA and is not State.
Respondents are State of U.P and 10 others – all connected to Jewar Airport in one way or another.
We need to provide arguments that Jewar Airport is being implemented by U.P. Government and its arms/department like Directorate of Civil Aviation and all other Bodies and thus it is a Project of STATE.
Please advise your interest or recommend a Senior Advocate who can help convince the Wall.
No personal interest except that I love to go Bird-Watching at Dhanauri Wetlands – a mesmerizing Birding Area and have been trying to save all wetlands in the Country via directions from NGT and Supreme Court.
