Navigating Challenges Between VIDYA-PSCHBS Ltd

A storm is brewing between VIDYA and PSCHBS over the use of premises in S Block.The vast land spanning 2.4 acres in S Block was granted on perpetual lease for the sole purpose of running a basic primary school. In 2004, an NGO called VIDYA was selected for the purpose. VIDYA is an NGO working exclusively for the education of around 250 underprivileged children living in Panchshila Park and neighboring clusters. The NGO VIDYA was selected and an MOU/Deed of License was signed between VIDYA and PSCHBS which is valid till March 2025.The lease was signed for 15 years from 2010-2025. In February 2024, the PSCHBS sent them a letter with “Subject: Notice for Eviction” stating the clause in the lease:”A notice period of one year will be given by the Society for vacation of the premises by VIDYA which will be complied by VIDYA without any demur or protest whatsoever. Should VIDYA want to vacate the premises, they will give the Society one year’s notice. The Society in an email to all the members of the Society has given a detailed explanation termed as “VIDYA Clarification” justifying the notice sent to Vidya with the clause stated above. According to the email sent to the members, the letter sent is a “Statutory Notice” to VIDYA. VIDYA’S reply to the letter states that they have been in discussion with the Society for peaceful running of the school for the past year and their understanding is that the decision would be taken along with the General Body.

Some concerned residents have initiated a signature campaign to show their collective resistance and unwavering support for VIDYA school. A letter with 117 signatures of members opposing the “Notice” has been submitted and have demanded that the matter be taken up in the SGM which will be held on 31st March, 2024. Caught in the crossfire are the innocent students whose educational journey hangs precariously in the balance. The prospect of displacement looms large casting a shadow of uncertainty over their academic pursuits. While the supporters of VIDYA school are lamenting the prioritization of profit over welfare of the underprivileged children, the MC feels it has to protect its assets by executing properly drafted legal agreements which are not detrimental to the society. An open dialogue where both sides can voice their concerns and grievances in a respectful and constructive manner may be the best way to move forward ensuring all perspectives are heard and considered.A resolution where the rights of the underprivileged children and concerns of the MC would be more than welcome for the Panchshila community.
