RWAs, Federations & Other Public Service Providers Should Demand Charge for Encroachments on Public Land

We are trying to find some solutions for encroachment problems being faced by law abiding citizens due to lethargic and corrupt attitude of our authorities and other government agencies at times due to political pressures.

This article is bit out of the box but could be effective. The idea got matured when we went through the communications that various departments had with DMRC that we received through RTI.

DDA, MCD and Airport Authority of India are charging DMRC for land permanently used at one time price @Rs.705.88 lakhs per acre (circle rates subject to change based on central govt notification) with lease agreement of Rs.1 per year for 99 years while temporary used land is charged in advance calculated @5% of Rs. 705.88 lakhs per acre X number of years required. All the agencies have earned crores of rupees from this important public utility company which is today the backbone of our city and helps in reducing pollution of various kinds. Ultimately, this money is charged from the commuters by way of tickets which we feel is not right. Instead, all these agencies including state government should contribute to DMRC to subsidize pollution free public transport system. 

The rental (temporary used by DMRC) for three years at Masoodpur is about Rs. 11 crores and earned by DDA. Looking at such amount one can come to the conclusion that all encroachments on public lands by various individuals as well as groups should be charged at similar rates and its occupation will fetch many crores of rupees for the public exchequer. Now this loss to public exchequer is due to non-performance of DDA, MCD, PWD and other law enforcement agencies. RWAs, Federations and other public service providers should demand this amount to be deposited in their accounts till encroachers are cleared of this land and restored for common use. The MCD and DDA are the culprits and they should deposit this amount calculated similarly into respective RWAs’ accounts for forcing our law-abiding residents in to inconvenience. Residents/ RWAs should start writing demand letters to agencies and build a strong case of claim of their rights over this loss.
